Date: The day after St Martin, 20 Edward I [12 November 1292].
Parties: William, abbot of Byldewas, querent, and Peter, son of Thomas Corebet.
Property: Concerning [a plea] that the abbot complained that Peter did not hold to him a fine made in the court of the lord king Henry, the father of the lord king Edward, before William de Ebor' and his fellows, itinerant justices of the lord king Henry at Salop', between Nicholas, formerly the abbot of Byldewas, the predecessor of the aforesaid abbot, querent, and Thomas Corebet, the father of Peter, whose heir he is, impedient, concerning 100 acres of land in Ulnesmor', and whereof the abbot complained that - whereas in the fine it is contained that Thomas granted for himself and his heirs that the abbot and his successors should be able to enclose all their land of Kynn[er]ton' and Ulnesmor' by ditch and hedge or otherwise, as seems most expedient to them, so that Thomas and his heirs should not be allowed to come within the land, or to hunt or to spread nets or to make trenches or stables* or other artifices for the taking of wild beasts in them [sic] without the assent and will of the abbot and his successors, except in pursuit of a beast of their forest into the enclosure - Peter has entered into the tenements and both in the sown lands and meadows and elsewhere within the enclosure has hunted and made trenches and stables and with nets and other artifices has taken wild beasts in the same place at his will and against the tenor of the fine. And - whereas in the fine it is contained that the abbot and his successors and their men of Kynn[er]ton' should be allowed to drive back the wild beasts of the forest of Thomas and his heirs found within the enclosure if they wish - Peter has not permitted the abbot and his aforesaid men to drive back the wild beasts, against the tenor of the fine. And - whereas in the fine it is contained that if the cattle of the abbot and his successors and their church of the Blessed Mary of Byldewas should be found in the forest or hay of Thomas and his heirs through straying they were to be delivered to the abbot and his successors by certain compensations limited in the fine - Peter has taken ransom from the abbot for this kind of straying at his will, and against the tenor of the fine.
Action: Plea of fine made.
Agreement: Peter has granted for himself and his heirs as much as is in them that the abbot and his successors and their church of the Blessed Mary of Buldewas shall have and hold their tenements enclosed by ditch and hedge or however they wish by the metes and bounds contained in the fine levied between Nicholas and Thomas, to wit, from the ford (vadum) of Kynn[er]ton' by the brook (riuulus) of Onye to Shotesfort and from there by Crukelesbrok' to Alrenbrok' and to Wythyenebrok' and under Hesenedone as far as Stakeneffort and as far as Blakerudyng' and thus by Shakeltre as far as Longebirche and to Stanhuste and thus to the spring and by Penlebrokesheued and by Redhull' and Grethull' and Penlebrok' into Rutonesbrok', and on the other side from the ford of Kynn[er]ton' by the conduit (Doytus) of Kynn[er]tone and between Inlondes to the small syke of Redwynesmor' and from the head of the same small syke by the old thorn tree as far as the way over Turf and thus by the same way as far as the way which leads towards Lynle and so directly opposite Wermondesle and Wythyenepulle, without objection or impediment of Peter and his heirs, for ever, saving however to Peter and his heirs and their men their ancient roads through the middle of the enclosure, as contained in the fine. And whereof 1 road is towards Norbery, 1 towards Wentenore, 1 at Shotesfort, 1 at Crokelesbrok', 1 at Haspeneford', 1 at Hesenedon', 1 between Murtherle and Alrenemore, 1 at Penbay, 1 at the head of Hullesmor', 1 towards Mongomery, 1 towards Lynle, 1 at Wythyenepol and 1 at Wermondesle. Peter has also granted for himself and his heirs that if his wild beasts are found henceforth within the enclosure that the abbot and his successors and their men will be allowed to drive back the wild beasts if they wish, without objection or impediment of Peter and his heirs or their bailiffs, without harm being done to the beasts. Peter has also granted for himself and his heirs that if the cattle of the abbot and his successors and their church enter the forest or hay of Peter and his heirs by straying, they shall be delivered to the abbot and his successors or their bailiffs immediately and according to the tax limited in the fine for this kind of straying, to wit, for the straying of each ox, bull, cow, horse and mare 3 pence, for the straying of 4 pigs 1 penny and for the straying of 5 sheep (bidentes) 1 penny, but for the straying of their calves, lambs and piglets nothing is to be exacted or taken. And besides Peter granted for himself and his heirs that they will not be allowed henceforth to dismount and lodge in the abbot's grange of Kynn[er]tone or to occupy his houses in the same place with their men, horses or dogs or to claim or take anything from the goods of the abbot and his successors and their church in the same place without the assent and will of the abbot and his successors or their bailiffs. And for this the abbot has granted for himself and his successors and their church that Peter and his heirs will henceforth be allowed to enter the enclosure by the aforesaid roads and to hunt in the enclosure everywhere except in sown land and meadows and to take wild beasts with their nets and other artifices at their will and to have free entry end exit by the same roads without objection or impediment of the abbot and his successors or their bailiffs. Provided however that Peter and his heirs will not be allowed within the enclosure to make trenches or to fell trees or to do any damage to crops and meadows within the enclosure as aforesaid. And besides the abbot remised and quitclaimed from himself to Peter all the damages which he said he had had by occasion that he did not hold the fine to him before. And this agreement was made between them saving to the abbot and his successors and their church and to Peter and his heirs all the other articles contained in the fine levied between Nicholas and Thomas and of which articles no mention is made in this fine.
